Winning on appeal in a suit to recover land expropriation compensation allegedly obtained by fraud
Overview
In a family dispute over the receipt and use of land expropriation compensation, the client was named as the defendant in a suit seeking return of money allegedly obtained by fraud.
The plaintiff's side claimed that the compensation had been received and disposed of without the landowner's consent, and sought its return.
Attorney Jaehoon Lee represented the client in the litigation.
Key Issues
The central issues were whether the landowner had given family members authority to receive and dispose of the expropriation compensation, and whether that expression of intent had been made under duress.
In particular, the question was whether, even if the landowner had permitted the receipt of the compensation, this could be seen as also granting authority over its use and disposal.
Our Work
Attorney Lee reviewed the findings in the related criminal case, the landowner's statements, the process of applying for payment of the compensation and the related materials, and argued that authority to receive and dispose of the expropriation compensation had been lawfully granted.
He also contested the plaintiff's claims of unauthorized receipt and duress, and defended the client's position by drawing together the findings made final in the related criminal case and the facts of the civil case.
Result
The appellate court ruled in the client's favor, and the client prevailed on appeal in the civil suit seeking return of land expropriation compensation.
