Civil suit by multiple lenders to recover loans and establish the joint liability of co-borrowers
Overview
Multiple lenders had repeatedly lent money over a long period to a married couple with whom they were acquainted. After being repaid only in part, they filed suit to recover the loans.
The other side disputed liability for repayment, arguing that the real party to the transactions was a third party or only one of the spouses. Attorney Jaehoon Lee represented five lenders in the loan recovery suit and on appeal.
Key Issues
The main issues were how to establish the formation of loan agreements and identify the actual borrower in money transactions repeated over a long period without any promissory notes, and whether the spouses were jointly liable as borrowers.
Another issue was how to distinguish loans from repayments among numerous deposits and withdrawals, and how to calculate the remaining debt by applying payments under the agreed interest and the Interest Limitation Act.
Our Work
Attorney Lee analyzed the long history of financial transactions for each lender, organized the loans and repayments, and reviewed how payments should be applied under the relevant laws.
In particular, he analyzed account records obtained through a court order to produce financial transaction information, identified the other side's payments for the purchase of real estate, repayment of loan interest and transfers of funds to and from other accounts, and on that basis rebutted the other side's claim that they had not been involved in the money transactions.
He also argued that the spouses were jointly liable as co-borrowers, drawing on witness testimony and financial transaction records together, and on appeal presented arguments supporting the correctness of the first-instance judgment.
Result
The clients prevailed in their suit to recover the loans and secured their legal rights to loan receivables that had gone uncollected for a long time.
