Overview

After a contract to build and install a large goliath crane at a shipyard was halted by the ordering company's workout, a dispute arose over the settlement payment in the course of amending the contract, resuming the work and taking over the equipment.

Attorney Jaehoon Lee represented a company that manufactures and supplies large industrial equipment in the lawsuit for the settlement payment.

Key Issues

The key issues were the validity and interpretation of the work stoppage and the agreement reached afterward, the actual percentage of completion of the large crane fabrication and installation work, and the obligation to pay the settlement amount.

In particular, how to calculate the percentage of completion given the characteristics of a shipyard goliath crane, and how to conduct a specialized expert appraisal, were important issues.

Our Work

Attorney Lee reviewed the crane fabrication and installation contract and its amendments, how the work was stopped and resumed, and the settlement agreements between the parties, and litigated the dispute over the obligation to pay the settlement amount.

He also analyzed the structure of the large goliath crane and the characteristics of its fabrication and installation to show how it differs from an ordinary construction tower crane, and argued that the court needed to appoint an appraiser with expertise in industrial machinery and experience with similar appraisals.

In addition, to ensure an accurate and fair appraisal, he made legal and technical arguments on the appraiser's expertise and on how the appraisal process should be conducted.
