A suit for the purchase price disputing the price and payment deadline for property slated for redevelopment
Overview
After a property slated for redevelopment was sold, a dispute arose between the seller and the buyer over the actual purchase price and when it was due.
The seller sued for the purchase price, claiming that the actual price was higher than the amount stated in the contract and that the buyer had breached an agreement to make an additional payment.
Attorney Jaehoon Lee represented the buyer in the suit for the purchase price.
Key Issues
The main issues were what the actual purchase price was under the real estate sales contract and a separate agreement drawn up later, and whether the additional payment agreement claimed by the seller existed.
The validity of the agreement to pay the purchase price when the property was sold after redevelopment was completed, and whether the payment deadline had arrived, were also at issue.
Our Work
Attorney Lee analyzed how the real estate sales contract was signed, the content of the later agreement and the dealings between the parties, and contested the other side's claims about the actual purchase price and the time of payment.
In particular, he pointed out that there was insufficient basis to recognize an additional payment obligation not stated in the contract or the separate agreement, and argued that under the agreement to pay the purchase price when the property was sold after redevelopment was completed, the payment deadline had not yet arrived.
He also reviewed the results of a fact inquiry on the progress of the redevelopment and the other side's plan of proof, and responded to the mediation procedure proposed by the court.
