Two detention warrant requests denied for a former military general in a bribery case involving a defense contractor
Overview
The client was investigated on allegations that, while serving as a general, he had received improper requests and accepted money in the course of duties involving a defense contractor.
Attorney Jaehoon Lee defended the client at the detention warrant stage.
Key Issues
The key issues were whether the bribery allegations against the client had been sufficiently shown and whether detention was necessary.
In particular, with the prosecution raising serious allegations and seeking detention, it was important to contest the prosecution's arguments on the alleged offenses and the grounds for detention.
Our Work
We reviewed the allegations presented by the prosecution and its arguments on the need for detention, and presented the client's position contesting the alleged offenses and the grounds for detention.
After the first request for a detention warrant was denied and the prosecution filed a second request, we again responded at the warrant hearing and argued that detention was not necessary.
Result
The court denied the first request for a detention warrant.
The prosecution then filed a second request, but the court denied that request as well, and the client was able to respond to the investigation without being detained.
