Overview

After an employee at a large amusement facility was seriously injured in a ride accident, the operating company, its CEO and the officers and employees involved were indicted for occupational negligence causing injury and violations of the Occupational Safety and Health Act. Attorney Jaehoon Lee defended the clients.

Key Issues

The main issues were whether the duty of care had been breached in the facility's safety management and in training and supervising employees, and how to assess the criminal liability of the company and its officers and employees, and an appropriate sentence, in light of how the accident occurred and the victim's own negligence.

Our Work

Attorney Lee took part in the criminal trial of the company and the officers and employees involved, reviewed the legal issues concerning how the accident occurred, responsibility for safety management, occupational negligence causing injury and violations of the Occupational Safety and Health Act, and conducted the defense.

Result

The prosecution sought imprisonment with labor for the CEO and imprisonment without labor for each of the employees involved, but the court sentenced the CEO and the employees to fines only.
