Overview

Allegations concerning a global automaker's vehicle emissions led to a large-scale criminal investigation of its Korean subsidiary and executives, and its foreign CEO was also indicted on charges of violating the relevant laws.

Attorney Jaehoon Lee defended the foreign executive, who was residing overseas.

Key Issues

The central issue was whether the foreign executive of the Korean subsidiary could be held criminally liable for problems that arose in the emissions certification and import of the vehicles.

Also important was how to respond to the criminal trial in Korea and exercise the right of defense while the client was residing overseas.

Our Work

Attorney Lee communicated remotely with the client, who was residing overseas, reviewed the facts of the case and the related legal questions, and handled the criminal trial in Korea.

He also analyzed technical data on emissions and reviewed emissions certification systems and related laws in Korea and abroad. On that basis, he organized the facts and legal issues of the case and represented the client's position in the trial proceedings in Korea, focusing on whether the client could be held criminally liable.
