Conviction under the Punishment of Violences Act overturned with an acquittal on appeal
Overview
The client was indicted for violating the Punishment of Violences, etc. Act (bodily injury by a group or with a deadly weapon) for allegedly injuring the victim with a dangerous object, and was sentenced to two years of imprisonment at the first instance. Attorney Jaehoon Lee defended the client on appeal.
Key Issues
The main issues were the credibility of the victim's statements and whether an injury inflicted with a dangerous object had been proven beyond a reasonable doubt.
Our Work
Attorney Lee pointed out that the victim's statements were inconsistent on key points, such as how the assault occurred and where the injuries were. He also analyzed the statements made immediately after the incident, the medical certificate and the objective evidence, and argued that the charged facts had not been sufficiently proven.
Result
The appellate court reversed the first-instance conviction and acquitted the client.
