Acquittal in an obstruction of business case over access passes for a U.S. military base construction site
Overview
The client was indicted for obstruction of business on allegations that, at a U.S. military base construction site, he had submitted access pass applications containing false information and caused access passes to be issued. Attorney Jaehoon Lee defended the client.
Key Issues
The key issues were how false information came to be entered on a number of access pass applications, whether and how the client was specifically involved, and whether the crime of obstruction of business could be established based only on the statements of those involved and the evidence submitted.
Our Work
Attorney Lee analyzed how each access pass application had been prepared and submitted and the related evidence, and separately examined whether the client had signed each one and was actually involved. He also pointed out inconsistencies between the statements of those involved and the objective records, and argued that the prosecution had not sufficiently proven its allegation that the client was involved in the false applications.
Result
The court acquitted the client. As a result, the risk that a conviction could have restricted the client's future participation in U.S. military base construction projects was also removed.
