Overview

Working with a local U.S. criminal defense attorney, we provided legal advice and handled the response in the criminal case of a client who had been arrested and detained on a Felony charge in the United States and then released on bail.

Key Issues

The main issues were whether the felony charge could be made out under U.S. criminal law and the likelihood of indictment, compliance with the bail conditions, and how to respond as the criminal proceedings moved forward.

A separate review was also needed of how the progress and outcome of the criminal case could affect the client's status under U.S. immigration law.

Our Work

Working with the local U.S. criminal defense attorney, Attorney Jaehoon Lee reviewed the facts of the case and the applicable law, and discussed response strategies as the investigation and proceedings developed.

In particular, he explained to the client in detail the structure and stages of the U.S. criminal justice process, the expected legal risks and the options going forward, and provided legal advice on complying with the bail conditions and on matters to be careful about during the criminal proceedings.

He also separately reviewed how the criminal case could affect the client's status under U.S. immigration law, including the client's immigration status, and provided a legal opinion on the matter.

Result

The U.S. Grand Jury declined to indict, and the case ended without the client being sent to a formal criminal trial on the felony charge.
