Overview
A client long resident in the United States wanted to confirm the Korean estate and inheritance rights after the client’s mother died, then divide the estate by agreement with the siblings. Jaehoon Lee investigated the assets, reviewed the rights and handled division negotiations.
Issues
The asset list supplied by some siblings needed to be checked for completeness. Omitted assets and lifetime gifts could affect inheritance shares, statutory forced-share rights and the division discussions.
Work
Real estate registrations and financial assets were checked against the one-stop inheritance inquiry service, tax and insurance records, and the siblings’ materials. The investigation identified real estate and financial assets omitted from the original list, as well as lifetime gifts to some heirs.
The findings informed a review of the heirs’ rights, including the client’s forced-share rights. In line with the client’s preference for agreement rather than litigation, negotiations proceeded on the basis of the confirmed assets and gifts.
Result
All heirs reached an estate division agreement without inheritance litigation. The client divided the estate after confirming the full asset position, including omitted assets and lifetime gifts, and reviewing the relevant rights.
